Restoring the Global Judiciary: Why the Supreme Court Should Rule in U.S. Foreign Affairs

 In a series of judgements over the last few years, the Supreme Court has allowed controversial foreign policy actions by President Trump to go forward, often under the justification that the president has significant leeway in handling foreign relations. In Restoring the Global Judiciary, Woodrow Wilson School professor Martin S. Flaherty argues that the Supreme Court has a historical and constitutional right to be a check on executive branch foreign-policy actions, and should exercise it for the good of the nation.
