Law and Judicial Duty

 (Harvard University Press)

The author traces the history of judicial review by examining how common ideals about law and judging gave rise to judicial decisions holding government acts unconstitutional.  The book challenges modern assumptions about the extent of judicial power and raises questions about the nature of law and the possibility of government under the law. Hamburger is the Maurice and Hilda Friedman Professor of Law at Columbia Law School, and author of Separation of Church and State.
